These terms and conditions and the documents referred to below (the ‘Terms’) apply to the use of the current website (the ‘Website’) and its related or connected services (collectively, the ‘Service’). You should carefully review these Terms as they contain important information concerning your rights and obligations concerning the use of the Website and form a binding legal agreement between you – our customer (the ‘Customer’), and us. By using this Website and/or accessing the Service, you, whether you are a guest or a registered user with an account (‘Account’), agree to be bound by these Terms, together with any amendments, which may be published from time to time. If you do not accept these Terms, you should refrain from accessing the Service and using the Website. The Service is owned by MEXBOSS Entertainment N.V. having its office at Zuikertuintjeweg Z/N (Zuikertuin Tower). Company Registration number 162576 (‘Company’), licensed in Curaçao under the License #GLH-OCCHKTW0703172023 issued by Gaming Services Provider N.V. for the provision of online games of chance.
2. General Terms
We reserve the right to revise and amend the Terms (including any documents referred to and linked to below) at any time. You should visit this page periodically to review the Terms and Conditions. Amendments will be binding and effective immediately upon publication on this Website. If you object to any such changes, you must immediately stop using the Service. Your continued use of the Website following such publication will indicate your agreement to be bound by the Terms as amended. Any bets not settled prior to the changed Terms taking effect will be subject to the pre-existing Terms.
3. Your Obligations
You acknowledge that at all times when accessing the Website and using the Service:
3.1. You are over 18, or the legal age at which gambling, or gaming activities are allowed under the law or jurisdiction that applies to you. We reserve the right to request proof of age documents from you at any time.
3.2. You are of legal capacity and can enter into a binding legal agreement with us. You must not access the Website or utilize the Service if you are not of legal capacity.

3.8. When placing bets you must not use any information obtained in breach of any legislation in force in the country in which you were when the bet was placed.
3.9. You are not acting on behalf of another party or for any commercial purposes, but solely on your own behalf as a private individual in a personal capacity.
3.10. You must not either attempt to manipulate any market or element within the Service in bad faith nor in a manner that adversely affects the integrity of the Service or us.
3.11. You must generally act in good faith in relation to us of the Service at all times and for all bets made using the Service.
3.12. You, or, if applicable, your employees, employers, agents, or family members, are not registered as an Affiliate in our Affiliate program.
4. Restricted use
4.1. You must not use the Service:
4.1.1. If you are under the age of 18 years (or below the age of majority as stipulated in the laws of the jurisdiction applicable to you) or if you are not legally able to enter into a binding legal agreement with us or you acting as an agent for, or otherwise on behalf, of a person under 18
years (or below the age of majority as stipulated in the laws of the jurisdiction applicable to you);
4.1.2. If you reside in a country in which access to online gambling to its residents or to any person within such country is prohibited.
4.1.3. If you are a resident of one of the following countries, or accessing the Website from one of the following countries:

4.1.4. To collect nicknames, e-mail addresses and/or other information of other Customers by any means (for example, by sending spam, other types of unsolicited emails or the unauthorised framing of, or linking to, the Service);
4.1.5. to disrupt or unduly affect or influence the activities of other Customers or the operation of the Service generally;
4.1.6. to promote unsolicited commercial advertisements, affiliate links, and other forms of solicitation which may be removed from the Service without notice;
4.1.7. in any way which, in our reasonable opinion, could be considered as an attempt to: (i) cheat the Service or another Customer using the Service; or (ii) collude with any other Customer using the Service in order to obtain a dishonest advantage;
4.1.8. to scrape our odds or violate any of our Intellectual Property Rights; or
4.1.9. for any unlawful activity whatsoever.
4.2. You cannot sell or transfer your account to third parties, nor can you acquire a player account from a third party.
4.3. You may not, in any manner, transfer funds between player accounts.
4.4. We may immediately terminate your Account upon written notice to you if you use the Service for unauthorised purposes. We may also take legal action against you for doing so in certain circumstances.
4.5. Employees of Company, its licensees, distributors, wholesalers, subsidiaries, advertising, promotional or other agencies, media partners, contractors, retailers and members of the immediate families of each are NOT allowed to use the Service for real money without prior consent from the
Company Director or CEO. Should such activity be discovered, the account(s) will be immediately terminated and all bonuses/winnings will be forfeited.
5. Registration
You agree that at all times when using the Service:
5.1. We reserve the right to refuse to accept a registration application from any applicant at our sole discretion and without any obligation to communicate a specific reason.
5.2. Before using the Service, you must personally complete the registration form and read and accept these Terms. In order to start betting on the Service or withdraw your winnings, we may require you to become a verified Customer which includes passing certain checks. You may be required to provide a valid proof of identification and any other document as it may be deemed necessary. This includes but is not limited to, a picture ID (copy of passport, driver’s licence or national ID card) and a recent utility bill listing your name and address as proof of residence. We reserve the right to suspend wagering or restrict Account options on any Account until the required information is received. This procedure is done in accordance with the applicable gaming regulation and the anti-money laundering legal requirements. Additionally, you will need to fund your Service Account using the payment methods set out on the payment section of our Website.
5.3. You have to provide accurate contact information, inclusive of a valid email address (“Registered Email Address”), and update such information in the future to keep it accurate. It is your responsibility to keep your contact details up to date on your Account. Failure to do so may result in you failing to receive important Account related notifications and information from us, including changes we make to these Terms. We identify and communicate with our Customers via their Registered Email Address. It is the responsibility of the Customer to maintain an active and unique email account, to provide us with the correct email address and to advise Company of any changes in their email address. Each Customer is wholly responsible for maintaining the security of his Registered Email Address to prevent the use of his Registered Email Address by any third party. Company shall not be responsible for any damages or losses deemed or alleged to have resulted from communications between Company and the Customer using the Registered Email Address. Any Customer not having an email address reachable by Company will have his Account suspended until such an address is provided to us. We will immediately suspend your Account upon written notice to you to this effect if you intentionally provide false or inaccurate personal information. We may also take legal action against you for doing so in certain circumstances and/or contact the relevant authorities who may also take action against you.
5.4. You are only allowed to register one Account with the Service. Accounts are subject to immediate closure if it is found that you have multiple Accounts registered with us. This includes the use of representatives, relatives, associates, affiliates, related parties, connected persons and/or third parties operating on your behalf.Only one Account for each household, IP address and computer or device is allowed. If two or more users share the same household, IP address and computer or device we must be informed by the respective Accounts’ holders in advance.
5.5. In order to ensure your financial worthiness and to confirm your identity, we may ask you to provide us with additional personal information, such as your name and surname, or use any third-party information providers we consider necessary. Should any additional personal information be obtained via third-party sources, we will inform you about the data obtained.
5.6. You must keep your password for the Service confidential. Provided that the Account information requested has been correctly supplied, we are entitled to assume that bets, deposits and withdrawals have been made by you. We advise you to change your password on a regular basis and never disclose it to any third party. It is your responsibility to protect your password and any failure to do so shall be at your sole risk and expense. You may log out of the Service at the end of each session. If you believe any of your Account information is being misused by a third party, or your Account has been hacked into, or your password has been discovered by a third party, you must notify us immediately. You must notify us if your Registered Email Address has been hacked into, we may, however, require you to provide additional information/ documentation so that we can verify your identity. We will immediately suspend your Account once we are aware of such an incident. In the meantime you are responsible for all activity on your Account including third party access, regardless of whether or not their access was authorized by you.
5.7. You must not at any time transmit any content or other information on the Service to another Customer or any other party by way of a screen capture (or other similar method), nor display any such information or content in a frame or in any other manner that is different from how it would appear if such Customer or third party had typed the URL for the Service into the browser line.
5.8. When registering, you will receive the possibility to use all currencies available on the website. Those will be the currencies of your deposits, withdrawals and bets placed and matched into the Service as set out in these Terms. Some payment methods do not process in all currencies. In such cases a processing currency will be displayed, along with a conversion calculator available on the page.
5.9. We are under no obligation to open an Account for you and our website sign-up page is merely an invitation to treat. It is entirely within our sole discretion whether or not to proceed with the opening of an Account for you and, should we refuse to open an Account for you, we are under no obligation to provide you with a reason for the refusal.
5.10. Upon receipt of your application, we may be in touch to request further information and/ or documentation from you in order for us to comply with our regulatory and legal obligations.
5.11 If you sign up or attempt to register more than one Account, for whatever reason, we may block or close any or all of your Accounts at our discretion. We may also void all the bets that have been placed in the duplicate Accounts, block bonuses and gifts and void withdrawal requests. In addition, any returns, winnings, or bonuses have been gained or accrued during the duplicate account lifecycle will be forfeited from you.
6. Your Account
6.1. Legal requirements
6.1.1. Reference to the “Account” shall mean an account registered by you on the Website after accepting and agreeing to these Terms. By registering an Account you declare that you are over 18 years of age or of a higher minimum legal age as stipulated in the jurisdiction of your residence under the laws applicable to you. It is your sole responsibility to know whether the services available on the Website are legal in the country of your residence. Persons who are under age of 18 years are not allowed to use the Website and/or any services available on it.
6.1.2. You are not allowed to register on the Website and use our services if you are a resident of Aruba, Australia, Bonaire, Curacao, France, Iran, Iraq, Netherlands, Saba, Spain, St Maarten, Statia, U.S.A or the U.S.A dependencies, United Kingdom. We reserve the right to refuse customers from any other countries over and above the aforementioned jurisdictions at our own discretion.
6.2. Registration of Account
6.2.1. In order to place bets, play games and deposit money you need to register the Account on the Website.
6.2.2. To register the Account, you must provide complete and up-to-date information including a mobile number, e-mail address, username, password and other mandatory information requested on the registration form.
6.2.3. By registering the Account on the Website you agree to specify your legal name. We may take action to check the accuracy of the information you provide. You’re not allowed to change this data, but there are cases in which you can individually request for changing of data by contacting Website customer support, such as an honest mistake etc.
6.2.4. If you choose, or you are provided with a username, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We are not responsible for any abuse or misuse of your Account by third parties due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party. We will never ask you to reveal your password and will never initiate contact with you to ask you for the memory joggers associated with your password.
6.2.5. Employees, former employees of service providers and/or affiliated persons are not permitted to register the accounts on the Website and cannot exploit the services and promotions available on it. Same rules apply to family members of the above mentioned. Violation of this rule will result in the account being permanently closed and the referred accounts will be considered as fraudulent. Any winnings derived from such activities will be deemed as forfeited by the account holder and only the deposited amount will be returned to the account holder.
6.2.6 You cannot transfer, sell, or pledge Your Account to another person. This prohibition includes the transfer of any assets of value of any kind, including but not limited to ownership of accounts, winnings, deposits, bets, rights and/or claims in connection with these assets, legal, commercial, or otherwise. The prohibition on said transfers also includes however is not limited to the encumbrance, pledging, assigning, usufruct, trading, brokering, hypothecation and/or gifting in cooperation with a fiduciary or any other third party, company, natural or legal individual, foundation and/or association in any way shape or form
6.3. Account issues
6.3.1. If you forget your password or think that somebody knows details of your personal data, moreover if you suspect that another user is taking an unfair advantage through cheating or collusion you must report the suspicion to us.
6.3.2. We reserve the right to declare any bet or transaction void partially or in full if we, at our own discretion, would deem it obvious that any of the following circumstances have occurred: 1) the Account holder or people associated with the Account holder may directly or indirectly influence the outcome of an event; 2) the Account holder and or people associated with the Account holder are directly or indirectly avoiding the rules of the Website; 3) the result of an event or the bet has been directly or indirectly affected by criminal activity; 4) the odds of an event have significantly been changed due to a public announcement in relation to the event; 5) bets have been placed that would not have been accepted otherwise, but they were accepted during periods when the Website have been affected by technical problems; 6) due to an error, such as a mistake, misprint, technical error, human error, force majeure or otherwise, bets have been offered, placed and or accepted due to this error.
6.3.3. When we close or suspend an Account for whatever reason, we reserve the right to close any future Accounts that may be registered by the same person, device, address, or that may use the same payment wallets or credit cards and void/cancel all bets and transactions of that Accounts.
6.3.4. We offer two-factor authentication (2FA) as additional protection from unauthorized use of your Account. You are responsible for keeping your login information confidential and making sure it cannot be accessed by another person.
6.4. By registering the Account on the Website you undertake, declare and warrant that:
6.4.1. You are over 18 years of age or such higher minimum legal age of majority as stipulated in the laws of jurisdiction applicable to you and, under the laws applicable to you, you are allowed to participate in the Games offered on the Website.
6.4.2. You will use this Website and your Account solely and exclusively for the purpose of your genuine participation in the Games and not for any financial or other operations; your participation in the Games will be strictly in your personal non-professional capacity for recreational and entertainment reasons only.
6.4.3. You participate in the Games on your own behalf and not on behalf of any other person;

6.4.5. All information that you provide to MEXBOSS Entertainment N.V. is true, complete, and correct, and that you shall immediately notify us of any change of such information.
6.4.6. You are solely responsible for reporting and accounting for any taxes applicable to you under relevant laws for any winnings that you receive from MEXBOSS Entertainment N.V..
6.4.7. All money that you deposit into your Account is not tainted with any illegality and, in particular, do not originate from any illegal activity or source.
6.4.8. You understand that by participating in the Games you take the risk of losing money deposited into your Account.
6.4.9. You shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to your or third parties’ participation in any of the Games and shall not use any software-assisted methods or techniques or hardware devices for your participation in any of the Games. MEXBOSS Entertainment N.V. hereby reserves the right to invalidate or close your Account or invalidate your participation in a Game in the event of such behavior.
6.4.10. In relation to deposits and withdrawals of funds into and from your Account, you shall only use credit cards and other financial instruments that are valid and lawfully belong to you.
6.4.11. The computer software that we make available to you is owned by MEXBOSS Entertainment N.V. or other third Parties and protected by copyright and other intellectual property laws. You may only use the software for your own personal, recreational uses in accordance with all rules, terms and conditions hereby established and in accordance with all applicable laws, rules and regulations.
6.4.12. Games played on the Website should be played in the same manner as games played in any other setting. You shall be courteous to other players and representatives of MEXBOSS Entertainment N.V. and shall avoid rude or obscene comments, including in chat rooms.
6.5. Accounts could use several currencies, in this case all Account balances and transactions appear in the currency used for the transaction.
6.6. We do not give credit for the use of the Service.
6.7. We may close or suspend an Account if you are not or we reasonably believe that you are not complying with these Terms, or to ensure the integrity or fairness of the Service or if we have other reasonable grounds to do so. We may not always be able to give you prior notice. If we close or suspend your Account due to you not complying with these Terms, we may cancel and/or void any of your bets and withhold any money in your account (including the deposit).
6.8. We reserve the right to close or suspend any Account without prior notice and return all funds. Contractual obligations already matured will however be honored.
6.9. We reserve the right to refuse, restrict, cancel or limit any wager at any time for whatever reason, including any bet perceived to be placed in a fraudulent manner in order to circumvent our betting limits and/ or our system regulations.
6.10. If any amount is mistakenly credited to your Account it remains our property and when we become aware of any such mistake, we shall notify you and the amount will be withdrawn from your Account.
6.11. If, for any reason, your Account goes overdrawn, you shall be in debt to us for the amount overdrawn.
6.12. You must inform us as soon as you become aware of any errors with respect to your Account.
6.13. Please remember that betting is purely for entertainment and pleasure and you should stop as soon as it stops being fun. Absolutely do not bet anything you can’t afford to lose. If you feel that you may have lost control of your gambling, we offer a self-exclusion option. Just send a message to our Customer Support Department using your Registered Email Address that you wish to SELF-EXCLUDE and this request will take effect within 24 hours from the moment of its receipt. In this case your account will be disabled until your further notice, and you won’t be able to login to it.
6.14. You cannot transfer, sell, or pledge Your Account to another person. This prohibition includes the transfer of any assets of value of any kind, including but not limited to ownership of accounts, winnings, deposits, bets, rights and/or claims in connection with these assets, legal, commercial or otherwise. The prohibition on said transfers also includes however is not limited to the encumbrance, pledging, assigning, usufruct, trading, brokering, hypothecation and/or gifting in cooperation with a fiduciary or any other third party, company, natural or legal individual, foundation and/or association in any way shape or form
6.15. Should you wish to close your account with us, please send an email from your Registered Email Address to our Customer Support Department via the links on the Website.
7. Inactive Accounts
7.1. We will charge you a fee of €5 (or currency equivalent) per calendar month (Inactive Account Fee) if: you have not logged into your Account or logged out from your Account, or used the Service, or made any bet in any section of the Service for twelve consecutive months or more (Account Activity); and your Account is in credit.
7.2. You will be notified that we will start charging you the fees on the eleventh month of inactivity and you will always have the option to log in and withdraw your funds.
7.3. The Inactive Account Fee will be withdrawn from your Account on a monthly basis to the extent that your Account remains in credit and only for the period during which there remains no Account Activity after the initial twelve month period has passed. If the Inactive Account Fee is due to be withdrawn from your Account and the balance of your Account is less than €5 (or equivalent currency), the Inactive Account Fee shall comprise the remaining funds in your Account.
8. Deposit of Funds
8.1. Fees and charges may apply to customer deposits and withdrawals, which can be found on the Website. In most cases we absorb transaction fees for deposits to your MEXBOSS Account. You are responsible for your own bank charges that you may incur due to depositing funds with us.
8.2. Company is not a financial institution and uses a third party electronic payment processor to process credit and debit card deposits; they are not processed directly by us. If you deposit funds by either a credit card or a debit card, your Account will only be credited if we receive an approval and authorization code from the payment issuing institution. If your card issuer gives no such authorisation, your Account will not be credited with those funds.
8.3. You agree to fully pay any and all payments and charges due to us or to payment providers in connection with your use of the Service. You further agree not to make any charge-backs or renounce or cancel or otherwise reverse any of your deposits, and in any such event you will refund and compensate us for such unpaid deposits including any expenses incurred by us in the process of collecting your deposit, and you agree that any winnings from wagers utilizing those charged back funds will be forfeited. You acknowledge and agree that your player account is not a bank account and is therefore not guaranteed, insured or otherwise protected by any deposit or banking insurance system or by any other similar insurance system of any other jurisdiction, including but not limited to your local jurisdiction. Furthermore, the player account does not bear interest on any of the funds held in it.
8.4. If you decide to accept any of our promotional or bonus offers by entering a bonus code during deposit, you agree to the Terms of Bonuses and terms of each specific bonus.
8.5. Funds originating from criminal and/or illegal and/or unauthorized activities must not be deposited with us.
8.6. If you deposit using your credit card, it is recommended that you retain a copy of Transaction Records and a copy of these Terms.
8.7. Internet Gambling may be illegal in the jurisdiction in which you are located; if so, you are not authorized to use your payment card to deposit on this site. It is your responsibility to know the laws concerning online gambling in your country of domicile.
8.8. To have a possibility to place bets and play for real money you have to deposit money into your Account. You can deposit at any time online by using your debit or credit card, e-wallet, via a bank transfer or via all available deposit methods. All available deposit methods you can find in “Deposit page” on the Website. Cash or cheques are not an accepted method of deposit. Please note that some of the methods may not be available in some countries.
8.9. You declare with each deposit that the to be deposited funds rightfully belong to you and that these funds have not been obtained or are derived from any illegal means. MEXBOSS Entertainment N.V. retains the right to request additional sources of funds based on a case-by-case basis.
8.10. The maximum amount the player is allowed to deposit per day/ 24 hours is EUR 100.000,00 (or the equivalent in the Account currency). Any deposits above said maximum amount may be canceled and returned by MEXBOSS Entertainment N.V. MEXBOSS Entertainment N.V. has the right to request you to provide to MEXBOSS Entertainment N.V. source of funds when you make/have made a deposit of an amount greater than [EUR][1000] (or the equivalent in the Account currency). We accept payments in various currencies. Any payment received by MEXBOSS Entertainment N.V. in a currency other than the currency of your Account will be converted into the currency of your Account, at the prevailing exchange rate. Please note that any exchange premiums are payable by you.
8.11. MEXBOSS Entertainment N.V. reserves the right to use additional procedures and means to verify your identity (KYC) when effecting deposits into an Account and to close an Account if you fail to send these documents to MEXBOSS Entertainment N.V..
8.12. MEXBOSS Entertainment N.V. does not grant any credit for the use of its services.
8.13. By depositing you confirm that all deposits are authorized and you won’t try to decline them or take any action which will cause such payment to be reversed by the third party, in order to avoid any legitimate liability.
8.14. As a prevention of money laundering, a deposit must be wagered at least once before a withdrawal can be made. Please note that if wagering requirements are in place, the wagering requirement needs to be respected before a withdrawal is requested.
8.15. MEXBOSS Entertainment N.V. doesn’t allow making 3rd party deposits (by a friend, relative, partner, wife or husband). All payments have to be made from an Account/system or credit card that is registered on the Account holder. If the 3rd party deposits are noticed all winnings will be forfeited and sent back to MEXBOSS Entertainment N.V., and the deposit will be returned to the rightful owner of an Account/credit card. If banking transfer requires a charge while returning money back to the rightful owner it will be paid by a receiver.
9. Withdrawal of Funds
9.1. You may withdraw any unutilized and cleared funds held in your player account by submitting a withdrawal request in accordance with our withdrawal conditions. The minimum withdrawal amount per transaction is € 10 (or equivalent in other currency) with the exception of an account closure in which case you may withdraw the full balance.
9.2. There are no withdrawal commissions if you roll over (wager) the deposit at least 1 time. Otherwise we are entitled to deduct a 40% fee with a minimum sum of 20 euro (or equivalent in your account currency) in order to combat money laundering.
9.3. We reserve the right to request photo ID, address confirmation or perform additional verification procedures (request your selfie, arrange a verification call etc.) for the purpose of identity verification prior to granting any withdrawals from your Account. We also reserve our rights to perform identity verification at any time during the lifetime of your relationship with us.
9.4. All withdrawals must be made to the original debit, credit card, bank account, method of payment used to make the payment to your Account. We may, and always at our own discretion, allow you to withdraw to a payment method from which your original deposit did not originate. This will always be subject to additional security checks.
9.5. Should you wish to withdraw funds but your account is either inaccessible, dormant, locked or closed, please contact our Customer Service Department.
9.6. In cases when your balance is at least 10 times larger than the total sum of your deposits, you will be limited to € 5,000 (or currency equivalent) for withdrawal per month. In other cases the maximum withdrawal amount per month is € 10,000.
9.7. Please note that we cannot guarantee successful processing of withdrawals or refunds in the event you breach the Restricted use policy stated in Clauses 3.3 and 4.
9.8. MEXBOSS Entertainment N.V. reserves the right to change the maximum allowed sum for each payment system per transaction at any time and without prior notification.
9.9. A withdrawal request will not be processed until all wagering requirements have been met.
9.10. It will not be possible to withdraw funds marked as “Bonus”, as well as funds stuck in an aborted game.
9.11. MEXBOSS Entertainment N.V. has the right to refuse withdrawal if the total bet amount is less than the amount of the last deposit. You have to turn over the initial deposit at least one time before being able to withdraw.
9.12. All withdrawal requests are processed within two (2) banking days, but there are cases where these timing can be longer, depending on payment channels, additional account checks and public holidays.
9.13. A user cannot withdraw funds in excess of his/her Account balance.
9.14. Withdrawals will be made to your bank account or other withdrawal methods available to you in “Cashier”. The withdrawals are processed by the method used by the user to deposit funds into Account balance. You may only withdraw the maximum amount of €1.000.000,00 (or the equivalent in the Account currency) in any twenty-four-hour period unless a larger amount has been agreed upon between you and MEXBOSS Entertainment N.V. MEXBOSS Entertainment N.V. may reject a withdrawal request if the suspicion arises that funds are being withdrawn for any fraudulent or money laundering reasons, pending the investigation thereto.
9.15. When a withdrawal is canceled, the funds are returned back to your Account and you can make use of those funds accordingly on the Account. MEXBOSS Entertainment N.V. does not assume any responsibility for any funds lost during gameplay following a withdrawal cancellation either by you or by us.
9.16. Please be advised that our products are consumed instantly during gameplay. Thus, we cannot provide refunds, returns of monies, or cancellation of the requested service when playing. If you play a Game with real money, the money will be drawn from your Account instantly.

If you win more than Euro 5.000.000,00 (or the equivalent in your Account currency), MEXBOSS Entertainment N.V. reserves the right to divide the payout into monthly installments of maximum Euro 5.000.000,00 (or the equivalent in your Account currency), until the full amount is paid out. All progressive jackpot wins will be paid in full.
9.22. The maximum daily winning amount for one Customer cannot exceed Euro 10.000.000,00 or the equivalent in your Account’s currency. The “day” means the time between 00:00 GMT and 23:59 GMT.
10. Payment Transactions and Processors
10.1. You are fully responsible for paying all monies owed to us. You must make all payments to us in good faith and not attempt to reverse a payment made or take any action which will cause such payment to be reversed by a third party in order to avoid a liability legitimately incurred. You will reimburse us for any charge-backs, denial or reversal of payment you make and any loss suffered by us as a consequence thereof. We reserve the right to also impose an administration fee of €50, or currency equivalent per charge-back, denial or reversal of payment you make.
10.2. We reserve the right to use third party electronic payment processors and or merchant banks to process payments made by you and you agree to be bound by their terms and conditions providing they are made aware to you and those terms do not conflict with these Terms.
10.3. All transactions made on our site might be checked to prevent money laundering or terrorism financing activity. Suspicious transactions will be reported to the relevant authority.
11. Errors, Malfunctions, and Interruptions
11.1 MEXBOSS makes every effort to ensure that no errors are made in prices offered or bets accepted. However, human and/or systems error may occasionally result in errors.
11.2 In this clause 10 we set out a description of the things that can go wrong and the rights that we have in such events. You should be aware however that this clause does not override or cancel out any rights that you may have under consumer laws and regulations and we do not intend that they should.
11.3 Below are some key definitions to help you understand this clause: A “Malfunction” refers to where an automated process fails to operate as designed or intended, for example where a piece of computer software produces a deviation from its intended performance specifications or parameters, or where two pieces of software fail to interface or communicate with each other in the manner intended or designed, in either case so as to produce a result which is not the result that was intended or designed. These malfunctions may or may not be apparent to us or to You and they may only come to light as and when settlement instructions, game outcomes, winnings or cashouts are investigated and analyzed retrospectively. An “Error” refers to a mistake or error that is not exclusively technical, for example the mistaken posting of incorrect odds, the offer of incorrect prices or terms for participation in a promotion or gambling opportunity. Errors can arise from human mistakes, administrative, operational or systems failures and combinations of all of these. For example, a bet might be offered mistakenly at a price that is substantially out of the market, or “each way” is offered in a market when the pricing of the market clearly indicates that it should have been “win only”, or a promotion designed to offer a €5 return might mistakenly advertise a €50 return or the pay-tables advertised for a product may mistakenly fail to reflect the true payment configuration of the product. 11.4 Where any of the above occur, we will deal with them as described below and it is important that you understand and agree to the following before you use the Services, as we made clear in the ‘Important Note’ at the top of these General Terms. Malfunctions
11.5 If as a result of a Malfunction, your Account is credited with winnings that you would not have received were it not for that Malfunction, we will have the right to void the relevant transaction and withhold the relevant winnings. 11.7 In the event of an Error, the same applies as for Malfunctions, as set out above. For sports betting markets only, in the case of any errors in prices transmitted (including so-called ‘palpable’, ‘obvious’, or ‘blatant’ errors, for example where the price being displayed is materially/significantly different from those available in the general market and/or the price is clearly incorrect, depending on all of the circumstances), MEXBOSS may settle Bets at the correct price at the time of acceptance (or the Starting Price in the case of horse-racing, whichever is the greater).
11.8 Where any Error is or becomes apparent or obvious to you or you suspect that an Error may be occurring, you agree that you will cease your use of the relevant Service(s) immediately, and will report it to us immediately. Interruptions
11.9 Our priority is to ensure that we deal with Interruptions in a way that is fair and does not systematically disadvantage our customers.
11.10 In relation to betting: we are entitled to suspend betting markets, void bets and return stakes to customers.
11.11 In relation to gaming: where an Interruption occurs after we receive notification of your gamble and where you can have no further influence on the outcome of the event or gamble, the results of the gamble will stand; where an Interruption to a single-participant single stage event occurs before an outcome has been generated we will return your stake to your Account; for games where there are multiple stages or decision points we will take all reasonable steps to restore the game to its last known state prior to the Interruption to enable you to complete the game; for games with multiple participants (equal chance or otherwise) we will deal with these as seems fairest to us (acting reasonably) on a case-by-case basis; and for games that are progressive jackpots, progressive jackpot values will be restored to their pre-failure state to the extent it is within our control and not the games provider.
12. Rules of Play, refunds and cancellations
12.1. The winner of an event will be determined on the date of the event’s settlement, and we will not recognize protested or overturned decisions for wagering purposes.
12.2. All results posted shall be final after 72 hours and no queries will be entertained after that period of time. Within 72 hours after results are posted, we will only reset/correct the results due to human error, system error or mistakes made by the referring results source.
12.3. If a match result is overturned for any reason by the governing body of the match within the payout period then all money will be refunded.
12.4. If a draw occurs in a game where a draw option is offered all stakes on a team win or lose will be lost. If a draw option is not offered then everyone receives a refund in the outcome of a draw on the match. And if a draw option has not been made available, then extra time will count, if played.
12.5. If a result cannot be validated by us, for instance if the feed broadcasting the event is interrupted (and cannot be verified by another source) then at our election, the wagers on that event will be deemed invalid and wagers refunded.
12.6. Minimum and maximum wager amounts on all events will be determined by us and are subject to change without prior written notice. We also reserve the right to adjust limits on individual Accounts as well.
12.7. Customers are solely responsible for their own Account transactions. Once a transaction is complete, it cannot be changed. We do not take responsibility for missing or duplicate wagers made by the Customer and will not entertain discrepancy requests because a play is missing or duplicated. Customers may review their transactions in the My Account section of the site after each session to ensure all requested wagers were accepted.
12.8. A matchup will have action as long as the two teams are correct, and regardless of the League header in which it is placed on our Website.
12.9. The start dates and times displayed on the Website for eSport matches are an indication only and are not guaranteed to be correct. If a match is suspended or postponed, and not resumed within 72 hours from the actual scheduled start time, the match will have no action and wagers will be refunded. 12.10. If an event is posted by us with an incorrect date, all wagers have action based on the date announced by the governing body.
12.11. If a team is using stand-ins, the result is still valid as it was the team’s choice to use the stand-ins.

13.1. All communications and notices to be given under these Terms by you to us shall be sent using a Customer Support form on the Website.

14. Matters Beyond Our Control
We cannot be held liable for any failure or delay in providing the Service due to an event of Force Majeure which could reasonably be considered to be outside our control despite our execution of reasonable preventative measures such as: an act of God; trade or labour dispute; power cut; act, failure or omission of any government or authority; obstruction or failure of telecommunication services; or any other delay or failure caused by a third party, and we will not be liable for any resulting loss or damage that you may suffer. TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT COMPENSATE YOU FOR ANY REASONABLY FORESEEABLE LOSS OR DAMAGE (EITHER DIRECT OR INDIRECT) YOU MAY SUFFER IF WE FAIL TO CARRY OUT OUR OBLIGATIONS UNDER THESE TERMS UNLESS WE BREACH ANY DUTIES IMPOSED ON US BY LAW (INCLUDING IF WE CAUSE DEATH OR PERSONAL INJURY BY OUR NEGLIGENCE) IN WHICH CASE WE SHALL NOT BE LIABLE TO YOU IF THAT FAILURE IS ATTRIBUTED TO: (I) YOUR OWN FAULT; (II) A THIRD PARTY UNCONNECTED WITH OUR PERFORMANCE OF THESE TERMS (FOR INSTANCE PROBLEMS DUE TO COMMUNICATIONS NETWORK PERFORMANCE, CONGESTION, AND CONNECTIVITY OR THE PERFORMANCE OF YOUR COMPUTER EQUIPMENT); OR (III) ANY OTHER EVENTS WHICH NEITHER WE NOR OUR SUPPLIERS COULD HAVE FORESEEN OR FORESTALLED EVEN IF WE OR THEY HAD TAKEN REASONABLE CARE. AS THIS SERVICE IS FOR CONSUMER USE ONLY WE WILL NOT BE LIABLE FOR ANY BUSINESS LOSSES OF ANY KIND.
15.2. IN THE EVENT THAT WE ARE HELD LIABLE FOR ANY EVENT UNDER THESE TERMS, OUR TOTAL AGGREGATE LIABILITY TO YOU UNDER OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED (A) THE VALUE OF THE BETS AND OR WAGERS YOU PLACED VIA YOUR ACCOUNT IN RESPECT OF THE RELEVANT BET/WAGER OR PRODUCT THAT GAVE RISE TO THE RELEVANT LIABILITY, OR (B) EUR €500 IN AGGREGATE, WHICHEVER IS LOWER.
15.3. WE STRONGLY RECOMMEND THAT YOU (I) TAKE CARE TO VERIFY THE SUITABILITY AND COMPATIBILITY OF THE SERVICE WITH YOUR OWN COMPUTER EQUIPMENT PRIOR TO USE; AND (II) TAKE REASONABLE PRECAUTIONS TO PROTECT YOURSELF AGAINST HARMFUL PROGRAMS OR DEVICES INCLUDING THROUGH INSTALLATION OF ANTI-VIRUS SOFTWARE.
16. Gambling By Those Under Age
16.1. If we suspect that you are or receive notification that you are currently under 18 years or were under 18 years (or below the age of majority as stipulated in the laws of the jurisdiction applicable to you) when you placed any bets through the Service your Account will be suspended (locked) to prevent you placing any further bets or making any withdrawals from your Account. We will then investigate the matter, including whether you have been betting as an agent for, or otherwise on behalf, of a person under 18 years (or below the age of majority as stipulated in the laws of the jurisdiction applicable to you). If having found that you: (a) are currently; (b) were under 18 years or below the majority age which applies to you at the relevant time; or (c) have been betting as an agent for or at the behest of a person under 18 years or below the majority age which applies:
· all winnings currently or due to be credited to your Account will be retained;
· all winnings gained from betting through the Service whilst under age must be paid to us on demand (if you fail to comply with this provision we will seek to recover all costs associated with recovery of such sums); and/or
· any monies deposited in your Account which are not winnings will be returned to you OR retained until you turn 18 years old at our sole discretion. 17. Fraud
We will seek criminal and contractual sanctions against any Customer involved in fraud, dishonesty or criminal acts. We will withhold payment to any Customer where any of these are suspected. The Customer shall indemnify and shall be liable to pay to us on demand all costs, charges or losses sustained or incurred by us (including any direct, indirect or consequential losses, loss of profit, loss of business and loss of reputation) arising directly or indirectly from the Customer’s fraud, dishonesty or criminal act.
17.1. Criminal Activity In the case when any irregularity (including a suspicion of attempted money-laundering or fraud) has been noticed, MEXBOSS Entertainment N.V. reserves the right to close Accounts and/or report about criminal or other suspicious activities provided through one or multi Accounts to the relevant existing regulatory or law enforcement authorities. All offenders’ Account balances will be blocked, withdrawals will be void, deposits and winnings will be forfeited.
17.2. Collusion and cheating MEXBOSS Entertainment N.V. is eligible to disable users Accounts and forfeit their Account balances (including deposits and winnings) if they will be noticed of gaining, attempting to gain an advantage of trading information of their cards or establishing a collusive agreement with other users to take an unfair advantage. These advantages may consist of chip dumping and transfer, discussing a hand during play, multiple using a single Account, soft playing. MEXBOSS Entertainment N.V. provides the rigorous examination of play by both manual and automated ways and investigates all related user complaints. In addition, MEXBOSS Entertainment N.V. provides proactively and randomly examining gameplays and Accounts.
17.3. Fraudulent activity Once MEXBOSS Entertainment N.V. noticed a fraudulent, unlawful, dishonest or improper activity (including using the VPN, proxy or similar service that masks or manipulates the identification of your real location, or making bets, wagers or poker play through a third party or on behalf of a third party) on the Website, we are eligible to block user’s Account with forfeiting of all Account balances without prior notification. In such cases, MEXBOSS Entertainment N.V. reserves the right to report fraudulent activity to existing regulatory and law enforcement authorities including but not limited to banks, credit card companies and/or any person or entity that has the legal right to such information, and/or taking legal action against such user.
18. Account Closure
7.1. You may close your Account at any time and request a withdrawal of the balance of the Account, subject to the deduction of relevant withdrawal charges. To close your Account, you must first cancel any open bets if applicable, and contact the Website customer support. The effective closure of the Account will correspond to the termination of MEXBOSS Entertainment N.V.. 21. Promotions: Terms & Conditions
21.1. Every individual promotion will come with its own set of specific promotional terms and conditions (the “Promotional Terms”) in addition to these Terms. 21.10. Bonuses and Bonus money

21.10.2.4. Any outside bet spread combination on Roulette games covering 24 or more (64%) of the 37 unique number spots on the table. E.g. betting on Red and Black – covers 36 of the 37 possible outcomes – in this case all winnings and bonuses will be voided.
21.10.2.5. 21.10.2.9. All bonuses have an expiry date. The standard expiry date for bonus money is 30 days. The expiry date can differ for specific bonuses. We may cancel or debit bonus credit from the player Account after the expiry date.

In addition, MEXBOSS Entertainment N.V. will cancel another and refund the stakes to players. There are exceptions to the general rule: The 48 hours rule is not supported in the Tennis games. All bets are available until the referee or official representative determines the winner. Nevertheless, there are cases in which a player retires. In this situation, all markets that are determined on the court are settled accordingly and all the rest declared void and stakes returned to players. If there are any doubts about the retirement of a player before the last point is concluded, the market of the match winner is canceled. Nevertheless, all markets that relate to the specific sets or games that are determined, are settled accordingly. Baseball games. The 48 hours rule is supported. When two teams are playing 2 games in a row they are considered as Game 1 and Game 2 and will be settled as chronologically played with all bets valid. For the avoidance of doubt, if Team A plays Team B twice, the result of Game 1 will count for bets offered on Game 1 as originally scheduled and the result of Game 2 will count for bets offered on Game 2, as originally scheduled. The 48 hours rule is valid. (e.g. if a football match is abandoned in the second half, the markets of the first half will be settled normally). (e.g. in the example above, the markets of the second match have not been decided) will be void and stakes will be refunded to customers.
24.9. Explanation of specific Betting Types If there is at least one Scorer when the match is abandoned, all bets made on the first Goalscorer will be applied and on the last will be canceled. A player will be determined as a winner according to the Goalscorer market at any time, and other players’ bets are void. Head 2 Head Bets These bets mean the prediction about taking the higher position, getting more points or results between two players. Head 2 Head bets will work if both players will do the best in the event. If two players get the same result or play out a draw, all bets will be void. Outright Bets These bets mean the prediction about taking the higher position, getting more points or results among the players (3+). Outright bets will work if all participants will actively take part in the event. In addition, bets on league, cup or other events in which the respective club/ organization is participating may not be placed or commissioned by those persons considered to be participating in the respective event. In the case of violation of these regulations, MEXBOSS Entertainment N.V. reserves the right to refuse payment of any winnings and already invested stakes as well as to cancel any bets. MEXBOSS Entertainment N.V. takes no responsibility for knowing if the user is a member of one of the mentioned groups. This means that MEXBOSS Entertainment N.V. is entitled to undertake any necessary measures at any time after the user has become known as being a member of one of the mentioned groups.
24.11. Live scoreboard details added on MEXBOSS Entertainment N.V. are for information purposes and are not a basis for settlement. All persons should ensure scoreboard details are correct before placing their bets.
25. Suspicious Betting
25.1 For the purpose of this clause 12, “suspicious betting” refers to where we have reasonable grounds to believe that a Bet or a number of Bet have been placed in suspicious circumstances. Suspicious betting shall include, but not be limited to:
25.1.1 where there is an inordinate frequency and/or highly unusual pattern of Bets (by comparison with betting norms) placed on the same selection(s) in a short space of time;
25.1.2 where there is an inordinate frequency and/or highly unusual pattern of Bets placed on the same selection(s) and where the theoretical probability of said selection(s) winning at the time of Bet(s) placement, based on the odds offered on the selection(s) at the time of Bet placement, is largely inconsistent with the theoretical probability of the same selection(s) winning calculated using their accumulated starting prices. By way of illustrative example only, if there was an inordinately large number of Bets placed on a multiple or permutation with combined odds of 250/1 (with a theoretical 0.004% probability of winning based on the odds) and that same multiple or permutation had combined odds of 12/1 based on the Starting Prices of the selections (a theoretical 7.7% probability of winning), this may trigger the suspicions contemplated by this clause
25.1.2;
25.1.3 where the integrity of an event (or events) has been called into question, including, for example, but not limited to where one (or more) of the participants in an event displays exceptional form which we reasonably believe was known to you or someone connected to you at the time of Bet placement but was concealed from the public generally in order to gain an unfair advantage in any Bets placed on that event (or those events);
25.1.4 where we have reasonable grounds to suspect that a Bet or a string of connected Bets were placed robotically, by automated means, or otherwise than through the Account holder placing each Bet manually via their Account (for the avoidance of doubt, this does not include bets placed via the Application Programming Interface (API);
25.1.5 where we reasonably believe that you have used unfair external factors or influences connected with the event(s) the subject of any Bet(s);
25.1.6 where we reasonably suspect that you have opened one or more Duplicate Accounts or where we reasonably suspect that second or subsequent accounts are under common control with your Account with a view to concealing the true worth, nature or pattern of Bets placed by you or on your behalf, even if second or subsequent accounts are opened under different names;
25.1.7 where we otherwise believe, acting reasonably, that you are acting in concert with others or that you are acting other than on your own behalf; or
25.1.8 where we reasonably believe that Bets have been placed from a location or device other than the location or device which you claim to have used to place a Bet; or
25.1.9 where we identify a pattern of Bets that have been placed in quick succession by different or the same Account holder(s) that have a combined liability which exceeds what we would expect to accrue on similar Bets during a particular time period based on long term established betting trends. For example, we would regard a series of Bets placed on the same or similar selections in quick succession after 9:30pm and before 8:00am by a different Account with a combined liability that exceeds € 100,000 as suspicious as this conflicts with our long term established betting trends.
25.2 If we discover or have reason to believe that you have participated in any of the activities described in clause
25.1 (which, as stated in clause 11.2, constitute “Prohibited Activities”), we shall have the rights set out in clause 13.
25.3 Where a Bet is deemed to be, or is declared, void by us prior to an event, any sum deducted from your Account with respect to that Bet shall be credited to your Account.
26. Prohibited Activities
26.1 You may only use the Services, including your Account, for lawful gambling in accordance with these General Terms. You may not engage in any activity which we define below as a “Prohibited Activity” and you acknowledge and understand that the consequences of you doing so, as we made clear in the ‘Important Note’ at the beginning of these General Terms, will (depending on the particular circumstances) include the voiding of any relevant transactions, the withholding of any winnings, and the suspension and/or closure of your Account.
26.2 The following activities are prohibited (each a “Prohibited Activity”):
26.2.1 if the name registered on your Account does not match the name on the financial/bank account and/or the debit (or where permitted, credit) card(s) used to make deposits on that Account;
26.2.2 if you appear, in our reasonable judgment, to be depositing or withdrawing money or otherwise using the Services without genuine play;
26.2.3 if you are located in, or are seeking to access your Account from, any Prohibited Territory either deliberately or accidentally, (including if you are using a VPN to disguise your location) or if you have sought to disguise or interfere with the IP address of the computer you are using to access the Services or otherwise take steps to prevent us from correctly identifying the IP address of the device you are using to access the Services;
26.2.4 if we have received a “charge-back” and/or a “return” notification via a deposit mechanism used on your Account;
26.2.5 if you use the Services other than for your own personal and recreational use, including if you are acting on behalf of any third party in connection with your Account;
26.2.6 if you deposit money into your Account which originates from any illegal activity or any illegal/unauthorized source;
26.2.7 if you provide incorrect or misleading information while registering for an Account (except where you provide any incorrect or misleading information in order to pass relevant age-verification checks, which situation will be dealt with as described in clause 4)
26.2.8 if you allow (whether intentionally or unintentionally) someone else to use your Account;
26.2.9 if you have deliberately or fraudulently opened or are using one or more Duplicate Account(s);
26.2.10 if you make or attempt to make a Bet when your Account contains insufficient cleared funds;
26.2.11 if you engage or if we suspect (acting reasonably) that you have engaged in any form of fraudulent or illegal activity, cheating, collusion (including in relation to charge-backs), money laundering, exploitation of Errors, Malfunctions or Interruption, utilization of software to gain an unfair advantage, suspicious betting (as defined and further explained in clause 25) or any other unlawful or improper activity;
26.2.12 if we discover that you are accessing the Services in contravention of the laws of the country where you are located;
26.2.13 if we suspect (acting reasonably) that your Account’s usage represents ‘business usage’ (‘business usage’ includes any use by a betting operator or any use by an individual or organization supplying data or services to a betting operator);
26.2.14 if you are prohibited from entering into a Bet by any term of your contract of employment or any rule of a sport governing body or other professional body which applies to you;
26.2.15 if you place a Bet on any sporting match or event in which you take part, or you otherwise break any of the rules or conditions relating to the placing of Bets;
26.2.16 if you transmit or provide any information or otherwise engage in any activity (such as, for example, so-called “courtsiding”) that assists a third party in the placing of Bets on any sporting event or contest whilst you are located in any territory where it is illegal to do place such Bets;
26.2.17 if you procure or arrange for a third party to transmit or provide information or otherwise engage in any activity (such as, for example, so-called “courtsiding”) that assists in the placing of Bets on any sporting event or contest whilst such third party is located in any territory where it is illegal to place such Bets;
26.2.18 if you intentionally match Exchange bets against your own account (or related account) with the intention of adversely affecting or manipulating a Market for your (or a related account’s) benefit;
26.2.19 if you attempt to use the Exchange to deliberately transfer money from one Account to another by attempting to match bets on a Market with another Account through collusion;
26.2.20 if you become bankrupt, if you do not make payment of a court judgment on time, if you make an arrangement with your creditors, or if any of your assets are the subject of any form of seizure, or if analogous proceedings are brought in relation to you anywhere in the world;
26.2.21 if you breach the terms of any promotion, for instance if you have opened more than one Account to take advantage of a promotion which was limited to one per customer;
26.2.22 if you engage in any abusive, offensive or otherwise inappropriate behavior towards other users of our Services (e.g., during gameplay, via our chat functions, etc.) or towards our staff;
26.2.23 if you breach the Terms of Use in some other material or serious way; or
26.2.24 if we become aware that you have played at any other online gambling site (including any site operated by a member of MEXBOSS’s group of companies) and, in connection with the same, you are suspected of or have engaged in any of the activities described in this clause
26.2.
27. Suspension or Termination of Your Account by Us
27.1 If we have reasonable grounds to suspect that you have engaged in any Prohibited Activity, we will suspend your Account without notification, and your Account will remain suspended while the matter is investigated. You agree to cooperate fully with any such investigation. Your funds cannot be accessed or withdrawn during periods of suspension, and any balance will remain in the Account. We may also make a report to the relevant regulatory or law enforcement authorities.
27.2 If our investigation results in our decision (acting reasonably) that the issue has been resolved to our satisfaction, we will lift the Account suspension. If our investigation results in our decision (acting reasonably) that you have engaged in any Prohibited Activity, we will restrict or permanently close your Account. In these circumstances, your details may be passed on to any applicable regulatory or law enforcement authorities or any other relevant external third parties.
27.3 We may also from time to time be required by a competent authority to restrict, suspend or close Accounts for legal or regulatory reasons. Such restrictions, if applicable, may affect your use of your Account.
27.4 We are also entitled to close your Account at any time for any reason (and without the obligation to provide a reason) by giving you no less than 14 days’ written notice.
27.5 Any balance in your Account at the time of any closure by us will be paid back to you, except that:

If you have withdrawn any sums which are attributable to Prohibited Activities, such sums shall be deemed to be held by you in trust for us and must be immediately repaid to us when a demand for payment is made by us to you.
28. Your License

Prohibited Behaviour includes, but is not limited to, accessing or using the Service to: promote or share information that you know is false, misleading or unlawful; conduct any unlawful or illegal activity, such as, but not limited to, any activity that furthers or promotes any criminal activity or enterprise, violates another Customer’s or any other third party’s privacy or other rights or that creates or spreads computer viruses; harm minors in any way; transmit or make available any content that is unlawful, harmful, threatening, abusive, tortuous, defamatory, vulgar, obscene, lewd, violent, hateful, or racially or ethnically or otherwise objectionable; transmit or make available any content that the user does not have a right to make available under any law or contractual or fiduciary relationship, including without limitation, any content that infringes a third party’s copyright, trademark or other intellectual property and proprietary rights; transmit or make available any content or material that contains any software virus or other computer or programming code (including HTML) designed to interrupt, destroy or alter the functionality of the Service, its presentation or any other website, computer software or hardware; interfere with, disrupt or reverse engineer the Service in any manner, including, without limitation, intercepting, emulating or redirecting the communication protocols used by us, creating or using cheats, mods or hacks or any other software designed to modify the Service, or using any software that intercepts or collects information from or through the Service; retrieve or index any information from the Service using any robot, spider or other automated mechanism; participate in any activity or action that, in the sole and entire unfettered discretion of us results or may result in another Customer being defrauded or scammed; transmit or make available any unsolicited or unauthorized advertising or mass mailing such as, but not limited to, junk mail, instant messaging, “spim”, “spam”, chain letters, pyramid schemes or other forms of solicitations; create Accounts on the Website by automated means or under false or fraudulent pretenses; impersonate another Customer or any other third party, or any other act or thing done that we reasonably consider to be contrary to our business principles. The above list of Prohibited Behaviour is not exhaustive and may be modified by us at any time or from time to time. No waiver by us, whether by conduct or otherwise, of a breach or threatened breach by you of any term or condition of these Terms shall be effective against, or binding upon, us unless made in writing and duly signed by us, and, unless otherwise provided in the written waiver, shall be limited to the specific breach waived. The failure of us to enforce at any time any term or condition of these Terms shall not be construed to be a waiver of such provision or of the right of us to enforce such provision at any other time.
33.4. Acknowledgement. By hereafter accessing or using the Service, you acknowledge having read, understood and agreed to each and every paragraph of these Terms. As a result, you hereby irrevocably waive any future argument, claim, demand or proceeding to the contrary of anything contained in these Terms.
33.5. Language. In the event of there being a discrepancy between the English language version of these rules and any other language version, the English language version will be deemed to be correct.
33.6. Governing Law. These Terms are governed by the law in force in Curaçao.
33.7. Entire agreement. These Terms constitute the entire agreement between you and us with respect to your access to and use of the Service, and supersedes all other prior agreements and communications, whether oral or written with respect to the subject matter hereof.
